Buying or Selling Property – Legal Questions Part 3

This is part three of our series on legal questions and answers.

Are there any specific things I need to be aware of?
  • Common areas of dispute include “bond clauses” and “72 hour clauses” in Offers to Purchase.
  • One needs to identify or disclose both visible and invisible defects.
  • Misunderstandings over neighbours’ rights to build and encroach on views and the like.
  • Building plans should be available. You will have a problem if a previous owner built or extended without proper plans.
What else should I know about?
  • What paperwork you will need (do you know where your title deed is?)
  • To whom any deposit and occupational rental must be paid.
  • Who gets paid interest earned on monies held in trust.
  • What compliance certificates you will need.
  • How to open or cancel a municipal service account.

In the next part of this series, we’ll look at the role of the conveyancer.
