The Sellers Condition Declaration


The “new” Property Practitioners Bill 2018 states that agents must only accept mandates together with a signed Sellers Condition Declaration.

This means that sellers must complete the Declaration at the same time as the mandate.
This Declaration must be attached to the sale agreement (Offer to Purchase).

It is the seller’s responsibility to disclose all defects to potential buyers.
Some of the details of this Declaration include:

  • The seller must be the registered owner or representative of the property.
  • They must declare that, to the best of their knowledge, the condition of their property on the date of signature was as stated in the Declaration.
  • They must also warrant that the fixtures and fittings have been fully paid for and are owned solely by the owner.
